Terms and Conditions Of The Dressing Room Dree

By accessing and using the TheDressingRoom website at www.thedresssingroomhire.com, you are accepting and consenting to the practices in these terms of use. “TheDressingRoom” (“we”, “our”, “us”) means its successors and assigns or any person acting on behalf of and with the authority of TheDressingRoom PTY LTD, ACN 910716887. “Rental Period” means the weekend hire or agreed to period that the User booked the dress for - starting from the day the dress is delivered to the User’s delivery address/ it has been picked up. Dress must be returned on Monday before 12pm or, if not weekend hire, on the next business day after the event. Weekend hires are generally received Thursday or Friday and to be returned at the post office the following Monday by 12pm. “Rental Price” (“price”) means the cost of the hire of the Dress as agreed between TheDressingRoom and the User. “Rental Return Due Date” means the date the Dress is expected to be back at TheDressingRoom' address. Any instructions received by TheDressingRoom from the User for the hire of Dress and/or the User’s acceptance of Dress supplied on hire by TheDressingRoom shall constitute acceptance of the terms and conditions contained herein. The on our website stated information under FAQ -frequently asked questions are part of our terms and conditions and you agree to have read and accepted them as binding.

Price and Payment
The Price shall be TheDressingRoom’ current price, at the date of delivery of the Dress, according to TheDressingRoom’ current Price list as detailed on TheDressingRoom’ website. TheDressingRoom reserves the right to change the Price in the event of a variation to the User’s requirements.

Cleaning fee
Hire prices stated on website do include the cleaning fee. We are responsible for the cleaning of the item. User shall not attempt to clean the garment them self under any circumstances. If the dress is heavily stained, especially with fake tan, user authorises TheDressingRoom to charge an extra fee of $30 AUD from card payed with. In the event that fake tan stains a garment or perfume damages the fabric and prevents it from being rehired (meaning the tan is not removable), TheDressingRoom reserves the right to charge the User 150% of recommended retail value stated in item description.

Security
TheDressingRoom requires a $50 AUD bond, which is fully refundable if the garment is returned in the same condition as it was delivered (excludes cleaning). Customer authorises TheDressingRoom to deduct repair or extra cleaning costs from this amount if any damages incurred. TheDressingRoom also requires a copy of the User's license and debit card (front & back) which will be destroyed when the garment is returned to TheDressingRoom.

Sizing
TheDressingRoom offers garments in different sizes, which is a recommendation only. Please ask us prior booking about the fit when unsure or try on the dress at a boutique. We offer a replacement garment if the necessary notice is given and the garment is returned that day or the next morning (if received after post hours) at the cost of the User. The user covers the return postal fees for the replacement garment + items listed price as determined by TheDressingRoom.

Cancelled order
TheDressingRoom may cancel your order. Due to an unforeseen event, the item you ordered suddenly became out of stock and is no longer available. If an item in your order does become unavailable, you will be contacted about the cancellation. If your order contains additional items, these items will still be shipped to you and the unavailable item will be removed from your order. You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from such cancellation. You will receive a full refund in case we cancelled your order. If an order was placed without checking availability or if you have exceeded the given time window that we kept the item on hold for you, a cancellation fee of $50 is applicable. You will be refunded the balance to the card payed with.
We will issue a store credit if the order was cancelled by customer 7 business days prior begin of your rental period. We do not refund payments for any cancellation. Bond can be refunded to your card if this was applicable to your order. Shipping fee is part of the store credit. If you contact us after dispatch of the garment, the rental period automatically started. We will not issue a store credit for a cancelled order if the required personal documents are not provided timely.

Rental Period and Late Fees
The rental period shall commence from when the User (or a third party nominated by the User) signs the Courier’s delivery receipt and shall continue until the Dress is lodged at the post office for its return. The item will arrive either one day before requested event date or on the day, depending on when the order was placed by customer.
Where the dress has not been returned to TheDressingRoom by the Rental Return Due Date then TheDressingRoom shall be entitled to charge additional hire fees until the Dress is returned to TheDressingRoom and the User expressly authorises TheDressingRoom to deduct such additional hire fees from the User’s credit card which was provided at the time of placement of the User’s order. Such additional charges shall be charged a fixed fee of $100 for each day overdue. Weekend hire returns have to be lodged at the post office on Monday before 12pm. Otherwise the hire will be returned on the day after event. If the User has not returned the rental item(s) within 15 days after the return date, TheDressingRoom will consider the rental item(s) as non-returned and will charge the User’s credit card 150% of the recommended retail value stated at item description minus late fees that the User has already paid. The rental fee will not be subtracted. In the rare case the user posted the return wrongfully (i.e. wrong street box or address, forgotten signature or similar) with thereby caused delay, customer will be charged the late fee. Garment must be returned from state that it had been delivered to (unless otherwise agreed).

SHIPPING POLICY
TheDressingRoom' standard delivery method is Express Signature operated by Australia Post. User bears the risk of delivery.
Order will be shipped timely to arrive on hire date (same day or day before). Earliest possible shipping is on the next business day (requiring placing of order until 6pm the previous day). Pick up must be liaised prior placing order.

Reliability/ Damage
The User shall inspect the Dress on delivery and shall within four (4) hours of receipt of the Dress notify TheDressingRoom (by phone or email) of any alleged defect, shortage in quantity, damage, failure to comply with what was ordered.
TheDressingRoom retains property in the dress nonetheless all risk for the dress passes to the User by time of sending at post office. The User accepts full responsibility for the safekeeping of the dress. It is the User's liability to rent timely/ in advance for TheDressingRoom to be able to send the garment in time. If you live in a rural area and the garment does not arrive prior event we will not refund.

Customers will not attempt to clean, repair, or alter garments at any time without consent from TheDressingRoom.
If the dress gets damaged or has been returned with wear and tear, the client will pay the repair/alteration fees. A quote will be provided by TheDressingRoom. The customer will not arrange repair. In addition to the repair fees, customer shall pay loss of business (any pre-booked bookings that can now not be fulfilled) and possible loss in value of item. If the item is damaged at a visible area affecting the look and quality of the dress and or the damage cannot be repaired in a manner that the dress becomes unable to hire, the customer will pay 150% of RRP stated on website or seek for replacement of garment within 7 days. The customer is liable to pay the lost business of the hire fee of the following week, if the dress was booked by the next customer and cannot be supplied due to delay caused by customer. If the dress gets lost, stolen or damaged beyond repair, whether or not such loss, theft, or damage is attributable to any negligence, failure, or omission of the User then the User will be liable to pay 150% of the RRP stated at the item description at TheDresingRoom' website (or if no RRP stated, the general RRP by the designer) minus late fees that the User has already paid OR replace the item in immaculate/new condition within 7 days. The customer is liable to pay the lost business of the hire fee of the following week, if the dress was booked by the next customer and cannot be supplied due to delay caused by customer. We advise that clients who intend to hire items be extra mindful if using fake tanning products or perfume. In the event that fake tan stains a garment or perfume damages the fabric and prevents it from being rehired, TheDressingRoom reserves the right to charge the User 150% of recommended retail value stated in item description. The User expressly authorises TheDressing Room to deduct such fees from the User’s credit card which was provided at the time of placement of the User’s order.

Returns
We can unfortunately not provide you with a refund or credit if you choose not to wear your garment or if it does not fit you.
Please lodge the return at the post office on Monday before 12pm (weekend hire) or on the day after event and get a receipt for proof of shipping.

Store credit
TheDressingRoom' monetary store credits are valid for 2 months and are transferable. In case of an unforeseeable event TheDressingRoom can cancel store credits (e.g. store stops operations) without refunding. Credits are not combinable with promotional codes. Store credits cannot be sold.

Promotional code
TheDressingRoom coupon codes to receive a certain percentage discounted are valid for strictly 2 months and non-transferable. They apply to hires only and cannot be applied on dress sales.

Exclusion from hiring service
We reserve the right to exclude individuals from our hiring service.

The laws of Australia govern our Terms and Conditions.

LIMITATION OF LIABILITY
TheDressingRoom will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from use or inability to use the website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorized access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if we have been advised of the possibility of such damages.

Where any Act of Parliament implies in the Terms and Conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in the Terms and Conditions, however, the liability for us on any breach of such term, condition or warranty shall be limited, at our option, to any one or more of the following:

if the breach relates to goods;
the replacement of the goods or supply of equivalent goods;
the repair of such goods;
the payment of the cost of replacing the goods or of acquiring equivalent goods; or
the payment of the cost of having the goods repaired; and
if the breach to relates to services:
the supplying of the services again; or
the payment of the cost of having the services supplied again.

PRIVACY POLICY
To process orders is necessary to obtain your personal information. It is important for us that persons with whom we do business have confidence that we handle information responsibly and it is our policy to do this. Except where otherwise legally appropriate we will treat your personal information as private. If you pay online using a credit card, the card details are not viewed by us or any person except you during the transaction. The details are encrypted and passed directly to the bank. We do not retain your credit card details.
